Refund policy
This English version is provided as a convenience translation only. The Italian version of this Policy is the sole legally binding text under Italian law and shall prevail in case of any discrepancy.

This Policy governs the right of withdrawal applicable to purchases made remotely through the Menichelli Watches website, a commercial brand of Menichelli s.r.l. Pursuant to Articles 52 et seq. of Italian Legislative Decree No. 206/2005 (the Consumer Code), customers acting as consumers are entitled to withdraw from the contract, without providing any reason and without penalty, within the timeframes and according to the terms set out below. The right of withdrawal applies to purchases concluded online or otherwise at a distance and does not apply to purchases made by parties acting for purposes related to their entrepreneurial, commercial, craft, or professional activity.
1. Withdrawal period
Consumers have the right to withdraw from the contract within 14 days from the day on which they, or a third party other than the carrier and designated by them, take physical possession of the goods.
In the case of multiple orders delivered separately, the withdrawal period begins on the day on which the consumer, or a third party designated by them, takes physical possession of the last item.
2. How to exercise the right of withdrawal
To exercise the right of withdrawal, the consumer must inform Menichelli s.r.l. of their decision to withdraw from the contract by means of an explicit statement, sent before the 14-day period expires.

Consumers may use the model withdrawal form provided at the end of this Policy, although its use is not mandatory. To meet the withdrawal deadline, it is sufficient that the notice is sent before the 14-day period expires.
3. Returning the goods
Where the right of withdrawal is exercised, the consumer is required to return the goods to Menichelli s.r.l. without undue delay and in any case within 14 days from the date on which they communicated their decision to withdraw.

The deadline is met provided the consumer dispatches the goods before the 14-day period expires.
Unless otherwise agreed, the direct costs of returning the goods shall be borne by the consumer.
4. Condition of returned goods
Goods must be returned intact, handled with reasonable care, and, as far as possible, complete with their original packaging, box, accessories, manuals, certificates, accompanying documentation, tags, and any other element delivered with the product.
The consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the product.
In the case of luxury timepieces, any signs of wear, damage, alteration, or absence of certificates, original boxes, accessories, seals, tags, or other essential elements may result in a reduction of the refundable amount, proportionate to the diminished value of the goods.
5. Refund
Where the right of withdrawal is validly exercised, Menichelli s.r.l. shall refund all payments received from the consumer, including any standard delivery costs, without undue delay and in any case within 14 days from the day on which it was informed of the consumer's decision to withdraw from the contract.
The refund shall be issued using the same means of payment used by the consumer for the original transaction, unless expressly agreed otherwise, and at no additional cost to the consumer.
Menichelli s.r.l. may, however, withhold the refund until it has received the goods, or until the consumer has provided evidence of having dispatched them, whichever occurs first.
If the consumer has expressly chosen a delivery method other than the least expensive standard delivery offered, any additional costs arising from such choice shall not be refunded.
6. Exclusions from the right of withdrawal
Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded in the cases provided for by law and, in particular, in the case of goods made to measure or clearly personalised.
By way of example, the right of withdrawal may not apply to watches personalised at the customer's request, engravings, specific modifications requested prior to delivery, or any other intervention that renders the product clearly personalised.
7. Withdrawal and legal warranty
The right of withdrawal is distinct from the legal warranty of conformity provided under applicable law in the event of a defective or non-conforming product. Where defects of conformity arise, the consumer may exercise the rights provided by law and by the general terms and conditions of sale published on the website.
